Local Insight

What NYC Investors Should Plan For

New York is a judicial foreclosure state, and many purchases involve co-op or condo boards, landmark rules or open building violations. Build extra time into your schedule and budget for permits through the Department of Buildings.

Every loan we make is business-purpose and closes in an entity such as an LLC. If you are refinancing, ask your closing attorney whether a CEMA (Consolidation, Extension and Modification Agreement) could reduce New York mortgage recording tax on the existing balance.

General information only, not legal advice. Confirm local rules with your closing attorney or title company.

01

Short-term rental rules

NYC's Local Law 18 restricts unhosted stays under 30 days, so we underwrite rentals on long-term rents.

02

Violations and permits

Open DOB or ECB violations are not automatically a deal-breaker; include their cure in your scope of work.

03

Attorney closings

NYC closings run through attorneys. Bring yours in early so title and lien searches don't hold up funding.
